Terms of Service

Your rights, obligations, and the rules that govern how Gelsomino works for you.

1 — Acceptance & scope

By using Gelsomino — including the anonymous verification preview at gelsomino.red, any registered account, or any paid subscription — you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

Who may accept. You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) and legally capable of entering into a binding contract. You may not use Gelsomino if you are located in, or are a national or resident of, a country subject to comprehensive sanctions administered by the EU, the UN, or the United States.

Scope. These Terms govern all Gelsomino surfaces, including:

The anonymous verification preview (gelsomino.red) — no signup required.
Registered free accounts (Gap Explorer tier).
Paid subscription accounts (Daily Voyager, Knowledge Autopilot, and any additional plans made available in the future).

Amendments. Gelsomino may update these Terms at any time. Material changes will be announced by email (for registered users) and/or by a notice on gelsomino.red at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page reflects the most recent version.

2 — Account terms

Signup. Gap Explorer (free tier) requires a valid email address and password. No credit card is required. You may sign up only once per person; duplicate accounts intended to circumvent per-account limits are prohibited.

Identity & accuracy. You must provide accurate information. You are responsible for keeping your account details current.

Security. You are responsible for the confidentiality of your login credentials and for all activity under your account. Notify us immediately at legal@gelsomino.red if you suspect unauthorised access.

Multi-device use. Paid subscriptions may be used on multiple personal devices belonging to the same individual subscriber. Sharing credentials across distinct individuals is not permitted.

Termination by you. You may close your account at any time via account settings. On closure, your data is deleted in accordance with our Privacy Policy.

Termination by Gelsomino. We may suspend or terminate your account, with or without prior notice, for:

Material breach of these Terms (including Acceptable Use violations).
Non-payment of applicable fees.
Actions that create legal or regulatory risk for Gelsomino.
If we cease to operate the service.

Where practical, we will provide advance notice and an opportunity to remedy a breach before terminating a paid account.

3 — Paid plans via Paddle (Merchant of Record)

3a — Payment processing and statutory rights

Payments are processed by Paddle.com ("Paddle") as merchant and reseller of record for all regions worldwide. This means Paddle — not Gelsomino — is the legal seller to you for billing, invoicing, VAT and sales-tax calculation and remittance, and PCI DSS compliance purposes. Your payment and billing data is governed by Paddle's own privacy policy and terms.

Refunds and statutory withdrawal requests are handled according to Paddle's Buyer Terms and Refund Policy. Nothing in our Terms limits statutory consumer rights you are entitled to under applicable law.

3b — Operational clarity: cancellation, refunds, and billing

Current paid plans (Step 1 launch). Two plans are available at launch:

Daily Voyager: €8 per month (founding rate for early subscribers).
Knowledge Autopilot: €12 per month (founding rate for early subscribers).

Standard prices for new subscribers after the full-functionality launch will be €10 and €15 per month respectively. Additional plans may become available in the future.

Billing cadence. Subscriptions are billed monthly on the anniversary of your initial signup date. Paddle issues a receipt and invoice directly to your registered billing email.

Tax. Paddle calculates and remits VAT, sales tax, and equivalent indirect taxes applicable to your jurisdiction. The price shown at checkout is inclusive of applicable tax where required by law.

Cancellation. You may cancel a paid subscription at any time through your account's subscription page (one-click cancellation) in the Gelsomino dashboard. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date.

Refunds and withdrawal. To request a refund or exercise a statutory right of withdrawal, use Paddle's customer portal (linked directly from your billing receipt and from your account subscription page). Gelsomino does not process payment refunds directly. The liability cap in Section 6 does not reduce any refund, cancellation, withdrawal, or statutory remedy you are entitled to receive under applicable law.

Account access after refund. If a refund is approved, your account reverts to the Gap Explorer free tier at the end of the paid period covered by the refunded charge (or immediately upon refund of a charge already processed, whichever Paddle's refund event triggers). You retain any saved history subject to Gap Explorer tier limits.

Trials. No free trials are offered during Step 1 launch. The founding rate described below is itself the introductory pricing wedge for early subscribers.

Chargebacks. Initiating a chargeback without first attempting to resolve the issue via Paddle's refund process is a material breach of these Terms and may result in account suspension.

Anonymous preview. The anonymous verification (gelsomino.red, no signup) is free and limited to one verification per browser session. It does not represent a subscription or a contract for ongoing services.

Free tier. Gap Explorer is a free tier requiring only email signup. No credit card is collected. Gap Explorer may be restructured or discontinued with reasonable notice, but Gelsomino will not reduce the entitlements of an active Gap Explorer account without at least 30 days' advance notice.

3c — Founding-rate definition and conditions

The founding rate (€8/month for Daily Voyager; €12/month for Knowledge Autopilot) applies while the same account remains active on the same product tier and billing cycle, excluding any of the following events, each of which releases Gelsomino from the founding-rate commitment:

1.Taxes — changes to applicable taxes, levies, or duties imposed on the transaction.
2.Payment-provider charges — changes to Paddle's fees, MoR surcharges, or other payment-provider costs that are passed through to the subscription price.
3.Abuse or fraud — if the account is found to have violated the Acceptable Use Policy or engaged in fraudulent activity.
4.Voluntary plan changes — if you voluntarily upgrade, downgrade, or switch to a different plan or billing cycle; the founding rate does not carry over to the new plan configuration.
5.Discontinued products — if the specific plan tier (Daily Voyager or Knowledge Autopilot as constituted at Step 1) is discontinued.
6.Legal changes — if a change in applicable law requires a change in the price, structure, or terms of the subscription.
7.Materially different replacement products — if the plan is replaced by a materially different product or service offering, even under the same name.

The founding rate does not carry over if a subscription is cancelled and restarted; upon restart, the then-current standard pricing applies.

3d — Founding rate and company continuity

The founding rate survives only while D.O.O. SENSEBRIDGE continues to operate the same Gelsomino service under the same product and pricing structure. In the event of an acquisition, merger, restructuring, or product discontinuation, the founding-rate commitment applies only to active subscribers at the time of such event and only for so long as the service continues under D.O.O. SENSEBRIDGE's operation without material change. If the service is transferred to a new legal entity or materially changed as part of such a transaction, Gelsomino (or its successor) will provide at least 60 days' advance written notice to affected founding-rate subscribers before any change takes effect.

3e — Refund Policy

This section explains how refunds, subscription cancellation, and statutory withdrawal rights work for Gelsomino subscriptions. It is written for clarity; if mandatory consumer law or Paddle's buyer terms gives you stronger rights, those rights apply.

Who handles payment refunds. Paid subscriptions are sold through Paddle, our Merchant of Record. Paddle is the legal seller for billing, tax, invoices, and payment refunds. Gelsomino provides the service but does not receive or store your card details and does not send refund payments directly to your bank or card.

How to request a refund. Start with Paddle's customer portal, linked from your Paddle receipt and from the subscription area of your Gelsomino account. You can also contact us at support@gelsomino.red and we will help route the request to the correct Paddle flow.

EU/EEA/UK cooling-off period. If you are an EU, EEA, or UK consumer, you normally have 14 days from the purchase or renewal date to withdraw from a distance contract. Because Gelsomino is a digital service made available immediately after purchase, the checkout may ask you to confirm that you want immediate access and understand how that affects your withdrawal right once you start using paid features. Nothing here limits any statutory right that cannot be waived under the law that applies to you.

Subscription cancellation. You may cancel a paid subscription at any time. Cancellation normally takes effect at the end of the current billing period, and you keep paid access until that date. We do not automatically refund the unused part of a month just because you cancel mid-cycle, unless mandatory law or Paddle's policy requires it.

Plan changes and prorating. If you upgrade, downgrade, or otherwise change a paid plan during a billing cycle, Paddle may calculate a prorated charge, credit, or adjustment according to the checkout terms shown to you and Paddle's billing rules. Any approved refund or credit is handled through Paddle.

Refund timing and destination. Approved refunds are returned through Paddle to the original payment method where possible. Most approved refunds should appear within 5-10 business days, but exact timing depends on the payment method, bank, card issuer, and local payment network.

Free tier. Gap Explorer and anonymous preview use are free. Because no payment is collected for those tiers, there is no payment to refund. If a free-tier account is later upgraded to a paid subscription, this Refund Policy applies only to the paid transaction.

Chargebacks. If something is wrong, please contact Paddle or support@gelsomino.red before starting a chargeback. This usually resolves the issue faster and keeps your account status clear while the request is reviewed.

4 — Acceptable use policy

You agree not to use Gelsomino to:

Automated abuse. Scrape, systematically extract, or automatically submit claims in bulk using bots, scripts, or other automated means. The anonymous verification quota (one per device session) must not be circumvented by cookie clearing or other technical means at scale.

Targeted harassment. Submit claims designed primarily to generate adverse scoring outputs against specific named private individuals for purposes of harassment, defamation, or targeted reputational damage campaigns not grounded in genuine public-interest fact-checking.

IP infringement. Submit content that infringes the intellectual property rights of third parties, including copyrighted material beyond fair use or fair dealing.

Sanctions evasion. Access the service from, or on behalf of entities located in, jurisdictions subject to comprehensive EU, UN, or US sanctions.

Misleading redistribution. Redistribute, publish, or share Gelsomino verification outputs in a manner that strips, distorts, or misrepresents the associated scores, source references, or disclaimers.

Service interference. Attempt to compromise the integrity, availability, or security of the Gelsomino platform.

Enforcement. Violations may result in temporary suspension or permanent termination of your account, without refund of unused subscription fees, at Gelsomino's reasonable discretion. Where required by law, Gelsomino may report violations to relevant authorities.

5 — Intellectual property

Gelsomino IP. Gelsomino and its licensors retain all intellectual property rights in the platform, software, scoring methodology (including the factual misleadingness score, manipulativeness score, credibility score, and risk score framework), brand, visual design, and generated output structure. Nothing in these Terms transfers ownership of Gelsomino IP to you.

Your content. You retain ownership of any claims or text you submit for verification. By submitting content, you grant Gelsomino a worldwide, royalty-free, non-exclusive, sublicensable licence to process, store, cache, and use your submissions solely for:

Delivering the verification result to you.
Operating, securing, debugging, evaluating, and improving the Service, including quality scoring and system reliability.

We do not permit third-party AI providers to train their models on customer content. We do not use customer content to train foundation models unless you give explicit consent. We may process submitted claims and related outputs to provide, secure, debug, evaluate, and improve the Service, including quality scoring and system reliability. Where possible, improvement uses aggregated, de-identified, or anonymised data.

This licence does not permit Gelsomino to publicly attribute submissions to you or to publish your claims under your name without your explicit consent.

Feedback. Any feedback, suggestions, or improvement ideas you provide to Gelsomino may be used by us without obligation to you.

Third-party source content. Gelsomino processes content from publicly accessible third-party sources (such as video transcripts, publicly published text, and RSS feeds). Gelsomino does not claim ownership of such third-party content and processes it under applicable fair use, fair dealing, or equivalent doctrines for the purpose of analysis and verification.

6 — Disclaimers & liability

Nothing in these Terms limits non-excludable rights

Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under applicable law. This includes any mandatory consumer rights, statutory remedies, withdrawal rights, refund rights, data-protection rights, and any liability that applicable law does not allow us to exclude or limit.

If you are a consumer, the limitations below apply only to the maximum extent permitted by the mandatory laws that protect you in your country of residence.

Analytical assistance, not a final professional decision

Gelsomino provides evidence search, claim analysis, source-linked snippets, trust indicators, risk indicators, factual misleadingness scores, manipulativeness scores, credibility scores, risk scores, and AI-assisted reasoning support. The Service is designed to help you review information more efficiently, but it does not replace your own judgment or independent verification.

You should not rely on Gelsomino as the sole basis for legal, medical, financial, investment, journalistic, academic, employment, public-safety, or other high-impact decisions. For such decisions, you are responsible for checking the underlying sources and obtaining appropriate professional advice where needed.

No guarantee that outputs are complete or error-free

We use reasonable care to provide useful and reliable analysis, but AI-assisted outputs may be incomplete, inaccurate, outdated, misclassified, or based on limited available sources. Evidence labels, trust scores, risk scores, summaries, translations, speaker attributions, and manipulation indicators are analytical aids, not guarantees of truth, completeness, legality, or suitability for your specific purpose.

Liability we do not exclude

We do not exclude or limit our liability where it would be unlawful to do so. In particular, nothing in these Terms excludes or limits liability for:

fraud or fraudulent misrepresentation;
intentional misconduct;
gross negligence, where liability for gross negligence cannot be excluded or limited under applicable law;
death or personal injury caused by negligence, where applicable;
breach of mandatory consumer rights;
breach of statutory rights that cannot be waived;
liability arising from data-protection law to the extent it cannot legally be limited;
any other liability that cannot be excluded or limited under applicable law.

Excluded losses where permitted by law

To the maximum extent permitted by applicable law (including the Law on Obligations of the Republic of Serbia), we are not liable for:

loss of profits, revenue, business, goodwill, reputation, opportunity, or anticipated savings;
indirect, incidental, special, punitive, exemplary, or consequential losses;
losses caused by your use of the Service as the sole basis for a high-impact decision without independent verification;
losses caused by content, sources, statements, or materials provided by third parties, except to the extent the loss is caused by our own breach of these Terms or by liability that cannot legally be excluded or limited;
losses caused by your submission of inaccurate, unlawful, confidential, or sensitive content where you did not have the right to submit it;
losses caused by events outside our reasonable control;
losses caused by service interruptions, maintenance, provider outages, network failures, or third-party platform restrictions (including upstream AI model providers or Paddle), except where mandatory law gives you a non-waivable remedy.

This clause does not limit any refund, cancellation, withdrawal, or statutory remedy that you are entitled to under applicable consumer law.

Cap on ordinary service liability

Subject to the non-excludable-rights, statutory-remedy, refund, data-protection, fraud, intentional-misconduct, gross-negligence, and personal-injury carve-outs above, our total aggregate liability to you for ordinary service-related claims arising out of or related to these Terms or the Service is limited to the greater of:

the total fees you paid to Gelsomino (via Paddle) in the twelve (12) months preceding the event giving rise to the claim; or
EUR 100.

This cap applies to ordinary service failures, including availability issues, software errors, incorrect analysis, lost access, delayed processing, defective outputs, and other contract-related claims, but only to the extent the cap is valid under applicable law.

Separate treatment of refunds and statutory remedies

The liability cap does not reduce any refund, cancellation, withdrawal, chargeback, or statutory remedy that you are legally entitled to receive. If a mandatory law gives you a stronger remedy than these Terms, that mandatory law applies.

Fair use of this limitation

The limitations in this section are intended to allocate risk fairly between you and us, taking into account the nature of the Service, the subscription price, the availability of source links and independent verification, and the fact that Gelsomino is an analytical support tool rather than a professional advisory service.

Force majeure

Gelsomino is not liable for failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, wars, government actions, infrastructure failures, or third-party platform outages (including upstream AI model providers or Paddle).

7 — Governing law & dispute resolution

Operator. This service is operated by D.O.O. SENSEBRIDGE (Društvo s ograničenom odgovornošću — a limited liability company registered under the laws of the Republic of Serbia).

Legal notices. All formal legal notices, security breach reports, and dispute notices must be sent in writing to: legal@gelsomino.red.

Governing law. These Terms are governed by and construed in accordance with the laws of the Republic of Serbia, subject to any mandatory consumer-protection, data-protection, private-international-law, or other statutory rights that cannot be waived or limited by contract.

If you are a consumer, this choice of law does not deprive you of any mandatory protection provided by the laws of your country of habitual residence where such protection cannot be waived by contract.

Jurisdiction for business users. If you use the Service for business, professional, journalistic, organisational, institutional, or other non-consumer purposes, any dispute arising out of or in connection with these Terms or the Service that cannot be resolved through negotiation shall be subject to the exclusive jurisdiction of the competent commercial courts of Belgrade, Republic of Serbia.

Consumer jurisdiction. If you are a consumer, the jurisdiction clause above does not limit any right you may have to bring proceedings in, or to be sued only in, the courts available to you under mandatory consumer-protection, civil-procedure, private-international-law, or other applicable laws of your country of residence. We will not rely on these Terms to require a consumer to resolve a dispute in a court or forum where such requirement would be invalid or unfair under applicable mandatory law.

Good-faith negotiation. Before initiating formal legal proceedings, the party raising the dispute should notify the other party in writing at legal@gelsomino.red and allow a 30-day period for good-faith negotiation toward resolution.

This negotiation period does not prevent either party from seeking urgent injunctive or protective relief, submitting a consumer complaint, exercising withdrawal, refund, cancellation, chargeback, or statutory remedy rights, contacting a competent regulator, or taking action where delay could prejudice a legal right or limitation period.

Consumer ADR. Nothing in these Terms limits any right you may have to use an available consumer alternative dispute resolution procedure under applicable law. We may consider ADR requests in good faith where an appropriate and competent ADR body is available, but these Terms do not require a consumer to use ADR where mandatory law gives the consumer a right to go directly to court.

Language. These Terms are provided in English and translations into Russian, Ukrainian, Serbian (Latin script), and Spanish may be made available. In the event of any conflict or inconsistency between the English version and any translated version, the English version controls, except where mandatory consumer law requires otherwise or where an ambiguity must be interpreted in favour of the consumer.
